Terms of Service

These Terms of Service govern your use of Voxetta Labs, LLC products and services, including the Gear-Life iOS application, the voxettalabs.com website, and any future Voxetta Labs products. By downloading or using any Voxetta Labs product, you agree to these terms.

1.1 Who We Are

Voxetta Labs, LLC is an independent software company incorporated in Florida, USA. We develop and publish health and fitness applications for iOS. Our products are independent and not affiliated with Apple Inc., Strava, Anthropic, or any other third-party platform mentioned in our applications.

1.2 Acceptance of Terms

By accessing voxettalabs.com or downloading any Voxetta Labs application from the App Store or TestFlight, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you are under 18, you confirm you have parental or guardian consent.

1.3 Changes to Terms

We may update these Terms as our products evolve. We will update the effective date above. Continued use of our products after changes constitutes acceptance. For material changes affecting paid products, we will provide in-app notice.

1.4 Intellectual Property

All Voxetta Labs products, including Gear-Life and Moments: Fitness Journal, their source code, designs, trademarks, brand names, and content are the intellectual property of Voxetta Labs, LLC. You may not copy, reproduce, distribute, or create derivative works from our products without written permission.

The name "Gear-Life," "Moments: Fitness Journal," "Sage," "Voxetta Labs," and the Gear-Life shoe logo are trademarks of Voxetta Labs, LLC.

1.5 Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble any Voxetta Labs application
• Use our products for any unlawful purpose
• Attempt to gain unauthorized access to any systems or data
• Use automated tools to scrape or extract data from our applications
• Impersonate Voxetta Labs or create misleading content claiming affiliation

2.1 License to Use

Subject to these Terms, Voxetta Labs grants you a limited, non-exclusive, non-transferable, revocable license to use Gear-Life for your personal, non-commercial use on Apple devices you own or control, as permitted by the App Store Terms of Service.

2.2 Free Core and Pro Purchases

Core (Free): The Core feature set of Gear-Life is free and available indefinitely. We commit to maintaining a meaningful free tier for the lifetime of the product.

Pro Unlock (one-time purchase): Pro is available as a one-time in-app purchase. Pricing is $5.99 for the first 500 founding members, then $2.99/month or $19.99/year. One-time purchases are non-refundable except as required by applicable law or Apple App Store policy.

The Lab (Claude AI credit packs): Claude AI credit packs are consumable in-app purchases. Credits are consumed as you use The Lab features. Credits are non-transferable and non-refundable once consumed.

2.3 Beta Testing (TestFlight)

During the beta period, Gear-Life is distributed via Apple TestFlight. Beta software may be unstable, incomplete, and subject to significant changes. By participating in the beta:

• You acknowledge the software is pre-release and may contain bugs
• You agree to provide feedback through TestFlight when possible
• You understand features may change or be removed before general release
• You will not publicly distribute or share beta builds

2.4 Health and Medical Disclaimer

Do not make health or training decisions based solely on information provided by Gear-Life. Always consult a qualified healthcare provider or certified coach for medical or training concerns. Voxetta Labs is not liable for injuries, health outcomes, or gear failures resulting from reliance on Gear-Life data.

2.5 Apple HealthKit

Gear-Life integrates with Apple HealthKit. Your use of HealthKit data within Gear-Life is also subject to Apple's HealthKit terms. Gear-Life reads HealthKit data solely to provide the features described in the app. We do not write to HealthKit except where explicitly stated in-app features (e.g., if future features log gear data back to Health). HealthKit data is never transmitted to Voxetta Labs servers.

2.6 Strava Integration

The optional Strava integration is governed by both these Terms and Strava's own Terms of Service. Gear-Life requests read-only access to your Strava activity data. You may disconnect Strava at any time in Settings. Your use of Strava's services remains subject to Strava's terms regardless of the Gear-Life integration.

2.7 The Lab (Anthropic Claude AI)

The Lab feature uses Anthropic's Claude AI API for advanced gear analysis. When you use The Lab, specific requests are processed by Anthropic's servers. Your use of The Lab is subject to both these Terms and Anthropic's usage policies. Voxetta Labs does not control Anthropic's data handling for API requests. We recommend reviewing Anthropic's privacy policy before using The Lab.

2.8 Sage AI Advisor

Sage is an AI-powered gear advisor. Sage's responses are generated by artificial intelligence and may occasionally be inaccurate, incomplete, or not applicable to your specific situation. Sage's gear recommendations are informational only. Voxetta Labs is not responsible for outcomes resulting from following Sage's advice.

Sage's availability and capability depends on your device. Apple Intelligence features require iPhone 15 Pro, 15 Pro Max, or iPhone 16 series. On unsupported devices, Sage is available through The Lab (Claude AI credit packs).

4.1 Disclaimer of Warranties

Gear-Life and all Voxetta Labs products are provided "as is" and "as available" without warranties of any kind, either express or implied. Voxetta Labs does not warrant that the applications will be error-free, uninterrupted, secure, or that defects will be corrected. We do not warrant the accuracy of any data, calculations, or recommendations provided by our applications.

4.2 Limitation of Liability

To the fullest extent permitted by applicable law, Voxetta Labs, LLC, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use our products.

In no event shall Voxetta Labs' total liability exceed the amount you paid for the specific product or feature giving rise to the claim in the 12 months preceding the claim.

4.3 Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Florida, and you consent to the personal jurisdiction of such courts.

4.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
